Definitions

The ‘Buyer’ refers to the person who buys or agrees to buy from the Seller. ‘The Goods’ are the goods supplied by the seller to the buyer. For all instances in these terms & conditions Cater-Force Food Service Engineers Ltd will be referred to as the ‘Seller’.

Price and Payment

Prices quoted do not include Value Added Tax which will be charged at the current rate of 20%. Free delivery for orders over £200.00 plus VAT to one UK mainland address. All prices shown on our website are given in good faith and are shown in pound sterling. We reserve the right to refuse any order at our absolute discretion.

Payment of goods should be made either by cash, cheque or bank transfer. All cheques should be made payable to Cater-Force FSE Ltd and posted to 15A High Street, Yeadon, Leeds, LS19 7SP. Payment terms for customers with credit accounts are 30 days from the Invoice date. For non account customers payment must be made at point of order and cleared funds available prior to delivery of the Goods. Interest may be charged at the Suppliers discretion on any accounts which are overdue with payment in line with the agreed terms.

Delivery

Free delivery applies to orders over £200.00 plus VAT to one UK mainland address. UK mainland excludes Northern Ireland, Isle of Man, Isle of Wight, Scottish Highlands, Islands and some areas of the Scottish mainland.

All goods must be examined upon delivery for obvious signs of damage and a note must be made on the drivers paperwork/electronic device. If this is not possible you must add the words ‘damaged’ to your signature. The buyer must inform Cater-Force FSE Ltd within 24 hours of receipt of any damage or shortage to the order.

The Buyer must ensure that there is adequate provision and personnel to receive goods once off-loaded from the vehicle as the driver is under no further obligation from that point. A signature is required upon delivery of all goods.

Should the buyer fail to take delivery at the agreed address and time, goods may be returned to our warehouse or the supplier. The costs incurred where goods are returned in relation to failed delivery attempts shall be passed on to the buyer. Deliveries required at specific times during the day will be charged extra.

Title & Risk

The property of the goods shall remain with Cater-Force FSE Ltd until such time as the invoice and any other invoices to be paid by the buyer are paid in full, but the risk of the goods passes to the customer on delivery.

Warranty

All Commercial Catering Equipment supplied carry a 12 month parts & labour warranty unless otherwise stated in the product description on our website, in our literature or agreed in writing from Cater-Force FSE Ltd. Where applicable parts and labour warranty only applies to UK mainland.

Consumables and door seals are not covered under warranty.

A back to base warranty will require the Buyer to safely ship the Good(s) back to the appropriate suppliers address. The arrangement and cost of this is the responsibility of the buyer. No loan machine or replacement will be supplied during this period.

Every effort will be made by us to handle service calls quickly, however the manufacturer will dictate the service arrangements. It may not be possible for service calls to be made on weekends, bank or public holidays, evenings or specific times the buyer specifies.

If a service call is requested during the guarantee period and the fault lies with the operation or installation and not the equipment itself then all charges relating to the call will be payable by the customer. Wear and tear is not covered by guarantee, nor is damage, misuse or lack of maintenance. Maintenance includes cleaning, de-scaling, replacement of parts after cleaning.

We reserve the right, at our absolute discretion, to charge for a call out before placing a service call. This charge will be refunded if it is deemed that the problem is not with the installation or the operator.

All Parts and Labour warranties are supplied by either the Manufacturer or UK distributor responsible for the importation of the commercial equipment.  A Warranty period starts from the Invoice date stated on the Sellers paperwork, and will be void along with the return of the goods, see ‘Returns’, if full payment is not received.

Service work and Spare parts have a 3 month warranty guarantee period unless otherwise stated in writing from Cater-Force.

Installation

All prices exclude installation unless specified on our website or in writing from the Supplier. The customer agrees to indemnify Cater-Force FSE Ltd against claims for defects caused to equipment by faulty or inadequate installation.

All Installations must be carried out by suitable lawfully qualified engineers. A certificate of installation should be made available if required by the Supplier on request for any installation.

The ‘Free’ Installation and Commissioning service is available on products at the discretion of Cater-Force FSE Ltd.  Power and services i.e. Gas, Electric and Water, where neccessary, must be available within 1 metre of the installation point.  If deemed by Cater-Force ‘Consumables’ are required to carry out the Installaiton i.e. pipework, cabling etc.., these can be charged at an extra cost.

Returns

Our returns policy apply to goods unused and as new, in their original packaging and with all instruction manuals. Special order \ bespoke goods may not be returned unless found to be damaged or faulty upon delivery.

The Seller at its discretion may agree to the return of Goods by the Buyer provided the Goods are returned at the buyers expense, in the same condition and in the original packaging. Any Goods agreed by the Seller as acceptable for return for any reason (excluding faulty goods) will be subject to a restocking charge of 25% of the nett Invoice value, together with the reimbursement of any expense incurred by the Seller as a consequence of the return of said Goods to the Sellers stock or to the suppliers stock.

Good(s) cannot be returned until the Seller has supplied the Buyer with a valid returns number. Our returns policy does not affect your statutory rights.

General

We reserve the right to change specifications to our products and services without prior notice.

Placing an order constitutes acceptance of the full terms and conditions laid out by Cater- Force FSE Ltd.

Force Majeure

The seller shall not be liable in respect of any breach of contract due to any cause beyond his reasonable control including act of God, inclement weather, flood, lightning or fire, industrial action, actions of government departments, war, terrorism, or the action of any party for whom the seller is not directly responsible.

Law and Jurisdiction

The contract shall be governed in accordance with the Laws of England and shall be subject only to the jurisdiction of the English courts.
